Tarichia pleaded guilty to the charge on May 25. At that court appearance, Tarichia's lawyer Justin Milne requested an intermittent or weekend sentence for his client. Milne said his client is employed with a non-profit organization in Charlottetown. An intermittent sentence would allow Tarichia to continue working for the organization full-time during the week, Milne added. Milne then provided the court with a copy of a paycheque to verify Tarichia's employment.

After the guilty plea on May 25, Crown attorney Chad McQuaid recounted in court the facts that led to the charge. He said that on Saturday, April 2 at around 8:30 p.m. in Stanley Bridge, the Queens District RCMP received a 911 call about a possible impaired driver on Route 6. The caller said the vehicle, a red Mazda, was swerving on the road and then it pulled into a gas station parking lot. The caller then gave police a description of the vehicle and its licence plate number.
