'We are not obliged to interview complainants' – acting Public Protector's office

Acting Public Protector Advocate Kholeka Gcaleka has hit back at claims by Freddie Nyathela, president of the SA Roadies Association , that her office did not interview him following her decision to clear former National Assembly speaker Thandi Modise of allegations that sheThis after Nyathela told City Press on Wednesday that Gcaleka closed an investigation without interviewing him.

Sara is a nonprofit organisation dedicated to the advancement and development of technical and production skills and knowledge of young people.'Acting Public Protector closed a probe against Thandi Modise without interviewing me' - complainant Msoki said Nyathela was therefore adequately notified of the Public Protector's intention to close the investigation and the latter was provided with"an extended opportunity to substantively object thereto, as provided for in the regulatory framework governing the Public Protector's investigations".

"It is true that Sara did not respond to the discretionary notice because the Public Protector made the very same abnormal process of issuing a discretional notice with Sara's complaint file against the Auditor-General. The discretionary notice was issued on September 8 2022 at 9:28am without the complainant being interviewed and the complainant responded on September 29 2022 at 4:04pm.

What has no bearing on the investigation and the complaint, he said, was the Auditor-General and the copy of minutes of a meeting of the standing committee on the Auditor-General, dated October 25 2019, which formed part of the key sources of information Gcaleka relied on to arrive at her decision, as stated page 10 of her closing report.

The report says Modise indicated that the committee did not find any reason to believe that officials had deliberately misled it.
