District Attorney Tony Matulewicz seeks to have Joseph J. Leschinskie Jr. disqualified because of two drug convictions.
New Shamokin councilman Joseph J. Leschinskie Jr. flashes a victory sign as he leaves the Northumberland County courthouse in Sunbury on Monday afternoon.SUNBURY – A man who won a seat on Shamokin City Council was sworn-in Monday and became an active member all while a Northumberland County district attorney tries to bar him because of a criminal record.
His civil complaint filed last Wednesday cites a section of the state constitution that prevents those convicted of “infamous” crimes from holding office in the commonwealth. Matulewicz argued Saylor could issue a temporary injunction if allowed to present evidence that allowing Leschinskie to serve would cause irreparable harm to Shamokin.
Although Saylor said he was bothered that proper procedure was not followed, he did not criticize Matulewicz, noting the district attorney deals mainly with the crimes code.Matulewicz could have filed his complaint when his name was placed on the ballot or after the November election, he claimed. But Leschinskie said Matulewicz waited “on purpose” until one business day before he was to take office, making it virtually impossible to obtain an attorney.
The DA’s complaint cites two 2009 felony drug convictions as the reason Leschinskie is not qualified to be a councilman.
