The jury began its deliberations in the Colton Cook homicide trial in Yarmouth in the early part of the afternoon on Thursday, Jan. 26. Said Cook's mother Stacey outside the courtroom afterward, 'Now we wait.'
Inside the hall at the Yarmouth Justice Centre. TINA COMEAU - Tina ComeauYARMOUTH, NS – After around 30 Crown and defence witnesses, and the entering of 35 evidence exhibits, the Colton Cook murder trial is now down to 12 people.
“You are the judges,” Justice Muise had told the jury as he neared the end of his charge, which he delivered the afternoon of Jan. 25 and the morning of Jan. 26. Since all jurors were able to see the trial through to its end, the identification numbers of two jurors were randomly pulled from a box and they were excused and thanked for their service, leaving seven women and five men to decide the outcome of this trial.
On day two of his jury charge, Justice Muise gave a detailed review of the trial evidence, which included, once again, revisiting the list of injuries that Cook had sustained, as well as the lengthy list of blood spatter evidence that was presented at trial.He also summarized the defence and Crown cases, and revisited the defence of intoxication that was put before the trial by Rogers’ defence team.
During his charge, Justice Muise also repeatedly reminded the jury that as an accused person, Rogers is presumed to be innocent in this trial and again, the ultimate issue to be decided on in this trial is did the Crown prove its case beyond a reasonable doubt.Asked for comment after the jury left the courtroom to begin its deliberations, Crown prosecutor Bob Morrison said the Crown was pleased with how the trial went.
