Justice Pierre Muise told the 14 jury members that he will begin his instructions to them on Wednesday afternoon, Jan. 25 and finish the following morning. After that the jury will begin its deliberations. The defence was first to present its closing summary to the jury on Jan. 24, during day 10 of the trial.

The defence told the jury an important part of their deliberations will be to weigh whether witnesses were credible and reliable. Brownell walked the jury through the defence’s opinion on what evidence the jury could accept, and highlighted some of the witnesses they could, or shouldn’t, rely on. Aside from being charged with accessory after the fact to murder in this case the defence said Siscoe wasn’t awake the whole time during that night, that his story changed over time, and that he gave different versions of events to the RCMP when compared to his trial testimony.Inside the hall at the Yarmouth Justice Centre. TINA COMEAUBrownell classified defendant Robert Rogers as “a credible but not totally reliable witness.

Rogers’ other lawyer, Nicholaus Fitch, reminded the jury of Siscoe’s testimony that Wayne Crawford had stabbed Cook countless times in the chest and that the medical examiner had said a sharp force injury had punctured Cook’s heart. The Crown noted Rogers had testified that he had no memory of attacking Cook and that he wasn’t involved in moving Cook’s body after he was dead. But Rogers told the RCMP in 2020 that he had backed Cook’s truck up to the front steps and they all put Cook’s body in his truck. He said he remembered Cook being “heavy.”
