The judge imposed a publication ban on details of the hearing to protect Smith’s right to a fair trial by a jury of his peers. The ban covers the evidence and submissions she heard and the reasons she gave for releasing Smith. The judge prohibited Smith from possessing or consuming alcohol or drugs, having any weapons and contacting one potential Crown witness.

The RCMP’s Southwest Nova major crime unit took over the investigation and executed search warrants at the home, a hotel and the minivan Smith had driven to the detachment.
