Boy claims he was defending someone else

Provincial court in Corner Brook. - SaltWire Network File PhotoCORNER BROOK, N.L. — A teenage boy may have been acting in defence of another person when he sprayed bear spray on two other people, but a Corner Brook judge has decided the Crown proved that the force utilized by the boy was unreasonable.

The teen, whose identity is protected under the Youth Criminal Justice Act, admitted he purposely sprayed one of his victims with the bear spray and that when he did so the other victim was hit by the spray. The incident occurred on June 28, 2021, when between 10 and 15 teens gathered near the fire hall in Mount Moriah.

The second victim, B, testified that he heard a pressurized spray can sound and saw an orange cloud come toward him. He tried to duck, but the spray landed on his arms, causing a burning sensation. B said he did not see A push anyone or act in an aggressive manner.
