Canadians with disabilities have long faced systemic barriers in accessing transportation, education and medical care. As a result, far too many Canadians with disabilities experience deep poverty and unemployment. Despite the passage of the federal, Canadians with disabilities are reminded again and again that barriers are ubiquitous.
While courts, grievance arbitrators and human rights tribunals have certainly interpreted the employer’s duty to accommodate robustly in some circumstances, decision-makers have all too frequently been reluctant to impose requirements on employers that might interfere with standard business practices. Deference to managers and their judgment to govern the workplace as they deem best has been the operative principle.
Similarly, post-secondary institutions have not fully taken advantage of advances in technology to promote new possibilities for online learning. Students with disabilities, who may face transportation barriers, are also likely to benefit as online learning becomes more widespread.Article content
