Pennsylvania’s former attorney general Kathleen Kane refused a blood-test following two-car crash in Scranton on Saturday evening, according to court documents.

“‘It’s totally not me’ and pointed to her front seat passenger,” she told police, according to the charging document. She told the officer she was the designated driver and said she was coming from picking up her sister from a local establishment. The driver of the other vehicle involved in the crash said he too smelled a strong odor of alcoholic beverages when Kane opened her car door. He asked if she was drunk, according to the document.

This appears to be Kane’s first arrest on a charge of driving while intoxicated, according to court records. Refusing a blood alcohol test after a driving under the influence arrest can result in a suspension of a driver’s license for a full year.
