The panel heard evidence from eight witnesses into a complaint by Sydney resident Arlene Whiffen against Const. Ronald Popwell of the Cape Breton Regional Police. MacDonald, who is also vice chair of the board, said at the outset of the hearing on Monday that the board is not bound by the findings of any other investigation and will base its decision on the evidence presented during the hearing.

Whiffen, who represented herself at the hearing, alleged that Popwell assaulted her in removing her cell phone from her hand. She further contends he used excessive force in removing her from a residential property at 80 Duffell Drive. According to the evidence presented, Whiffen, who lives on the same street, testified that on Feb. 14, 2021, she noticed a moving van at the home and stopped to see what was happening.

MacInnis had requested prior to the incident that Popwell prepare a protection of property order which was done but later rescinded when the officer failed to properly date the document and recorded the wrong birthdate for Whiffen.
