Brixton, a golden retriever, was purchased in August 2021 from a breeder. The couple broke up nine months later in May 2022. Emmalee MacKinnon countered explaining when the couple was together, she was with the dog 90 per cent of the time and that Ryan MacKinnon showed little interest in the dog. “When we split, Ryan got everything, the house, and everything we put into it, the dog was the only thing I asked for,” said Emmalee MacKinnon, adding that sharing the dog has not had a positive impact on his mental health.
When it comes to the law, Young noted that animals — dogs included — are considered personal property and disputes are to be decided on the basis of ownership and not on the best interests of the animal.
