Opinion: Yes, former Brazilian President Jair Bolsonaro has rights in America, too
Given that Bolsonaro has yet to be formally charged and the Brazilian government has not formally requested his extradition, under due process, he would be able to remain in the country according to the terms of his visa. Current speculation is that the former president is traveling under an A-1 visa reserved for heads of state. State Department spokesperson Ned Pricethat a person on this visa would have to depart the country within 30 days or apply for a change of immigration status.
The United States has little to gain by forcing Bolsonaro off its soil; only scoring a few points with the Democratic Party in the US and Lula supporters in Brazil. Until the former president is charged or violates US visa law, there are not enough reasons to engage in a political circus. In 2018 the US extradited former Panamanian President, but only after Panama levied charges and made a formal request for his return.
US policymakers should continue to condemn the violence in Brazil and voice their support for democracy. However, they must not act prematurely – Bolsonaro should be allowed to stay in the US – for now.
