But Fraser said a section of the Criminal Code which allows fines in lieu of forfeiture orders, and custody for failing to pay the fines, was a more appropriate method to deal with the stolen cash.Article content “The problem with a order is there is no incentive to make restitution, as there are no consequences if not paid other than the victim filing a civil order of judgment,” he said.While Fraser could have set that period as high as five years, he ordered Mann serve the minimum three years if she fails to pay up.
Fraser agreed with Johnston that even though new changes by parliament in the CSO legislations made such a sentence an option, it wasn’t appropriate in Mann’s case.
