Woman Falls on Bus, Loses Negligence Suit Against Driver and Operator

A Singapore woman in her late 60s lost a negligence suit against a bus driver and operator after falling while boarding a double-decker bus. The judge ruled in favor of the driver and operator, stating that the woman's fall was not due to negligence on their part.

A woman in her late 60s has lost a civil negligence suit against transport operator SBS Transit (SBST) and the bus driver after she fell while climbing the stairs of a double-decker bus. In a written judgment published on Feb 11, District Judge Samuel Wee stated that while he sympathized with the woman's pain and suffering, he found that the fault did not lie with the bus driver.

He based his decision on video footage from the bus, which showed the woman missing a step, losing her balance, and falling as the bus moved off from the bus stop. The woman, Madam Tran Thi Phuong Nga, had alleged that the driver, Lui Nai Yu, had moved off before ensuring she was properly seated and should have paid more attention to her because she was elderly. She also claimed that Lui had moved off or stopped the bus with sudden jerks and had been steering with only one hand. However, the driver denied breaching his duty of care, stating that he did not have to wait for Madam Nga to be seated before moving off and that he did not move off or stop jerkily. He also asserted that he had controlled the steering wheel appropriately despite using only one hand. After reviewing cases from Australian, English, and Scottish courts, Judge Wee concluded that it is generally not necessary for a bus driver to wait for all passengers to be seated before moving off. He found no merit to Madam Nga's argument that the driver should not have spoken to the female passenger. The footage showed that no other passengers lost their balance when the bus moved off or came to a halt. As Madam Nga failed to establish that the defendants were negligent, the suit was dismissed and will not proceed to the subsequent stage to prove causation and address the quantification of damages.
