It's another instance of the state's judiciary overruling the governor's authority during the COVID-19 coronavirus pandemic.
, Evers directed the state's Department of Health and Human Services Secretary Andrea Palm to extend the order from April 24 to May 26, but in a 4-3 decision, the Supreme Court ruled the administration must get legislative approval to enact such an extension., the order isn't struck down entirely just yet, with the stay-at-home policies remaining in place until May 20 to give the government time to draw up a new plan.
During oral arguments last week, Justice Rebecca Bradley asked, “Isn’t it the very definition of tyranny for one person to order people to be imprisoned for going to work, among other ordinarily lawful activities,” according to theAssistant Attorney General Colin Roth argued that the state's health service had the authority"to do whatever is necessary" to protect public health.
