The petition is “a distraction from the inevitable fact that this land is going to get developed,” Councilmember Shawn Kumagai said.
DUBLIN — A recently approved major housing development has been reluctantly scrapped by the Dublin City Council, after a petition by some residents against the plans forced the council to either repeal its approval or put the project on a ballot to let voters decide its fate.
However, Trumark could propose a similar development in the same place, city officials said, one that the council may have no choice but to approve under state laws meant to encourage homebuilding. “The look of our city is more urban sprawl now than the town and country scene that many moved here for. We don’t want Dublin to look like San Francisco or L.A.,” the website said.If the council put the project on the ballot and it was rejected by voters, the developer would have to wait at least a year to bring it back to the council. However, a different project at the same site could be considered sooner.
Tony Bosowski, a division president for Trumark, wrote a letter to the council on Feb. 25, asking the council to repeal approval of the project. City Attorney John Bakker said state laws intended to address the housing crisis, such as the Housing Accountability Act, or SB 330, mean the council could be forced to approve a new Trumark proposal for the same land if the developer can show that it fits in with the city’s existing general plan and development guidelines for the land.
