Holomisa suggests Ramaphosa should be called to testify at PP impeachment inquiry
Ebrahim again reiterates that he does not believe that the section 194 inquiry process against Mkhwebane has been tainted by illegality - but says it is within Mkhwebane's right to challenge its jurisdiction.Ebrahim says personal costs orders given against any official are given in circumstances where the courts want to demonstrate their displeasure about their conduct.
Dyantyi then tells Mpofu that he is"urging you to wrap up" - but says Ebrahim could be asked to return to complete his cross examination by Mpofu.In his ruling on the costs order granted against Mkhwebane in the Gauteng High Court in Pretoria, Justice Mbuyiseli Madlanga said personal costs orders against public officials were warranted only when their conduct was egregious or they had disregarded their professional duties.
He makes reference to the ConCourt's ruling overturning a personal costs order given against Mkhwebane in the SARS/Zuma case - in which the apex court found that, because Mkhwebane had relied on legal advice about her office's right to subpoena Jacob Zuma's tax records, she should not be forced to personally pay 15% of SARS's legal costs.
