The Utah Supreme Court dismissed a case filed by Utah Congressional Candidate Colby Jenkins.

Jenkins formally requested the recount in the election on Monday, July 29, but followed it up late Tuesday, July 30, with a lawsuit contesting the certification of results over 1,171 ballots that had been disqualified for late postmarking.

Jenkins’ suit argued more than 1,100 ballots were rejected because of the late postmark, some of which were processed in Las Vegas possibly accounting for the late mark.Following the Tuesday ruling, Jenkins conceded the race to Utah Congresswoman Celeste Maloy. "We urge the legislature and the governor to address this critical issue in the next legislative session to prevent such disenfranchisement from occurring in the future."“With the recent Utah Supreme Court decision, I am grateful to our supporters, our county clerks, and the people of Utah's 2nd Congressional District. I look forward to earning your vote again this November and working to advance Utah's conservative agenda.
