“I was tried on the fake impeachment hoax on Jan 6, and they tried it in the Senate, they went through the whole process, and we won,” Trump said.
US Attorney General Merrick Garland appointed, on Friday, a special counsel to run two investigations on Trump.“We went through the whole process, so wouldn’t this sort of be a — and then you take a look at the other, we went through two of them – and isn’t this sort of like double jeopardy?” the former president floated. Trump’s argument doesn’t appear to pass legal muster.
The Fifth Amendment’s double jeopardy clause prohibits anyone from being prosecuted twice for the same crime, however, the Constitution explicitlythat impeached individuals “shall nevertheless be liable and subject to indictment, trial, judgment and punishment.” The former commander-in-chief added that he saw the defeat of Rep. Liz Cheney , vice chairwoman of the House Jan. 6 committee, in Wyoming’s Republican primary as the “final nail in the coffin” related to the government’s probe into his actions leading up to the riot at the Capitol building.
