'We need to find an end to this,' says justice of the peace during Wednesday court appearance for Charles McMillan, accused of careless driving causing death

After almost a year and a half and numerous court appearances, a trial date will soon be set for a dump truck driver accused of careless driving causing the death of 51-year-old Maria Gagliardi.

Charles McMillan appeared in person before justice of the peace Kathleen Bryant at the provincial courthouse on Wednesday, dressed in blue jeans and a black printed t-shirt. If found guilty, he faces up to two years in prison.McMillan is facing one charge of careless driving causing death in the May 27, 2021 incident. At the time, police called it a hit-and-run, but after an investigation McMillan was not charged criminally.

At the time, the Sault Ste. Marie Police Service said an investigation into the collision determined Gagliardi was walking in the Second Line West and Brunswick Avenue area when she was struck and killed by a dump truck, which was travelling south on Brunswick and turning west on Second Line.“Mr. McMillan, it is time we move this forward. It has to go to a trial or a resolution, there’s no way around it," she said. “We need to find an end to this.

Bryant asked if a defence lawyer has been hired, to which McMillan responded he is still waiting on two phone calls."I just got the money, I don't have a job anymore," replied McMillan.In that incident, McMillan was charged with three offences, including careless driving, driving a commercial vehicle with no licence, and notice of drivers licence suspension for operating a commercial motor vehicle with a blood alcohol concentration above zero.

His employer, FKM Trucking, was also charged for allowing an unlicenced driver to operate a commercial vehicle.Assistant Crown attorney Matthew Caputo told Bryant a period of incarceration is being sought by the Crown in this case.Caputo replied it was his understanding that McMillan has been informed of that right a number of times over the past year and a half.A judicial pre trial has been set for Nov. 21, after which dates will be set for the trial.
