On Monday, the Government triggered Section 35 of the Scotland Act, a never-before-used provision which allows the Scottish secretary to kill a bill passed by the Scottish parliament if they believe it interferes with areas of law controlled in London. The target was the SNP’s new bill liberalising the rules on gender recognition for trans people.
Section 35 has a two-stage test: First, the Scottish bill in question must make “modifications” to reserved law – the bundle of non-devolved legislation which comes under Westminster’s jurisdiction. And second, the Government must have “reasonable grounds” to believe it would have “an adverse effect on the operation” of the reserved law.
The new Scottish legislation does not change anything in the Equalities Act. Instead, it changes the rules in the Gender Recognition Act 2004 about how you change your sex. The circumstances around the Equalities Act have changed, but the law itself remains unaltered. But he had a problem. As he himself admitted, the number of people changing their gender in Scotland per year under the new rules is likely to be around 550. Such a small number suggests that the problems the British government is raising are completely disproportionate to the response it is pursuing.
