“Sufficient post-election remedies exist that permit the voter to challenge any infirmity in the proposed amendment and its placement on the ballot — after the voters have had their say,” Justice Jane Bland wrote in the opinion. “This precedent invites municipalities to disregard well-established election laws regarding charter amendments, protections for unborn babies, and numerous other issues, an unintended but foreseeable consequence,” Texas Alliance for Life spokesperson Amy O’Donnell said in a written statement.

Paxton was the first to file an amicus brief urging the Republican-controlled Texas Supreme Court to block the charter amendment from getting on the ballot. A Feb. 16 news release from his office noted the amendment “contains numerous left-wing policy initiatives.” The Texas Supreme Court declined to weigh in on the merits of Texas Alliance for Life’s argument that the proposition violates the Texas Local Government Code’s prohibition on “multiple-subject charter amendments.” The court also didn't directly address thedue to the abstention of three council members.
