Suspended NAC boss’ bid to set aside Public Protector’s report is challenged
This was after the NAC withdrew its own application to review Mkhwebane’s report, which emanated from a complaint lodged by Nyathela in 2017 in which he alleged abuse of power and subversion of due processes process by Mangope.
Mkhwebane also found that the allegation that Mangope had applied to the NAC’s executive committee for a R350 000 annual partnership on behalf of Nyathela without his knowledge was substantiated.In his answering affidavit, which City Press had seen, Nyathela said Mangope stated in her founding affidavit that she had been suspended since February 27 2021.
“The applicant [Mangope] fails to indicate the authority and/or capacity under which she prosecutes this application as she is currently on suspension,” Nyathela’s affidavit reads. City Press had seen a letter dated June 23 2021, addressed to Nyathela by Diphofa, in which the latter apologises to Nyathela for declining his application.
