Lawyers for a high-profile man charged with rape west of Brisbane have formally appealed a court's decision to allow his identity to be revealed

But immediately after Ms Kelly refused the non-publication order, the man's lawyers sought a temporary stay in order to lodge an appeal. Mr Hoare said the lawyers had not been given a transcript of the hearing and decision from Friday's proceedings and needed to view this to define the particulars of the appeal.

Last week in Toowoomba, the court heard that the complainant in the matter wanted the man identified and named. The new laws have provision for people who can demonstrate a risk to safety, undue hardship or distress, or that the order is necessary to prevent prejudice to the proper administration of justice to have their identity suppressed.
