SGI has filed an appeal of a judge's decision that a report questioning a whether a man was fit to drive must be released to him.
He did as the Crown corporation requested, and they left him with his steering papers, which were not suspended or restricted. But the man wanted to know who’d questioned his fitness behind the wheel, so he embarked on a years-long process that likely taught him much about how government bureaucracy handles sensitive information.
The public insurance corporation denied Giesbrecht’s request for the confidential report despite a February 2022 recommendation of the Office of the Saskatchewan Information and Privacy Commissioner to hand over the information. Clackson was unconvinced and ordered the report, in its entirety, to be turned over to Giesbrecht within 30 days — an order now stayed by Jackson.First, the Crown feels the judge was mistaken in his finding on the limitations of the Health Information Protection Act in allowing the withholding of information. Second, it feels Clackson erred in “determining that confidentiality over SGI’s investigative process is not required for the driver reporting scheme in s. 238 of The Traffic Safety Act” .
SGI’s aforementioned characterizations of Clackson’s findings and its assertions about them have yet to be scrutinized by the higher court. The news seems to be flying at us faster all the time.
