The San Francisco Police Department is investigating a man who used a hose to spray an apparently homeless woman on Montgomery Street.

Twitter screenshot via @briochesfIn a viral video that began circulating Monday, Collier Gwin can be seen spraying the woman as she shouts and tries to shield her body. In a statement to SFGATE, the Lawyers’ Committee for Civil Rights of the San Francisco Bay Area and the ACLU of Northern California called the incident an"assault."

SFPD told SFGATE Monday afternoon that officers responded to the hosing incident as a"possible assault," but both Gwin and the woman"declined further police action at that time." In a subsequent statement, however, police clarified,"We are still investigating," and"The criminal action has not been determined at this time."that he sprayed the woman because she refused prior police orders to move from doorways to businesses on the street.

SFPD said that officers first responded to scene at 8:40 a.m. regarding"an adult female who was blocking a business' doorway" and that the woman complied with an officer's request to move from the doorway. Then, according to SFPD, officers returned at 12:04 p.m. after the spraying took place. The video shows that the woman was on the sidewalk, and not a doorway.
