San Francisco District Attorney Brooke Jenkins said she will not file murder charges against a private security guard accused of fatally shooting an alleged shoplifter in front of a Walgreens store April 27.
Jenkins said evidence shows that Michael Earl-Wayne Anthony, 33, felt he was in “mortal danger” and was acting in self-defense when he shot San Francisco man Banko Brown, a statement from the DA said. “We reviewed witness statements, statements from the suspect, and video footage of the incident and it does not meet the People’s burden to be able to prove beyond a reasonable doubt to a jury that the suspect is guilty of a crime,” Jenkins said.After careful review, we are not pursuing murder charges at this time because of credible evidence of reasonable self-defense.Police arrested Anthony on a charge of homicide following the shooting reported at 6:33 p.m.
Monday afternoon, people who knew Brown and community activists gathered in front of the Walgreens store in a rally organized by the Young Women's Freedom Center. The group said in a that Brown had been struggling to find housing in San Francisco for more than 10 years, and instead of receiving a place to sleep, he was criminalized.
