The Gauteng High Court in Pretoria has ruled that audio of the testimony of the next witness in the Senzo Meyiwa murder trial may be broadcast live. | AlexMitchley

On Monday, the State brought an application to block live visual and audio broadcasts of the witness' testimony.

The witness in question was at the scene when the former Bafana Bafana captain was shot dead on 26 October 2014, in the house of singer Kelly Khumalo's mother in Vosloorus, east of Johannesburg. The State argued that the witness feared for her safety and that she would be subjected to public ridicule if her testimony was broadcast live.

But the media and the defence teams opposed the application. Lawyers representing news organisations covering the trial centred their arguments on the right to freedom of expression and the principle of open justice. It was also put to the court that the witness had not told the court about her fears and that she had been interviewed and had commented on the trial before she was called as a witness, suggesting that she had already opened herself up to public scrutiny.

Judge Tshifhiwa Maumela found that the witness did not give adequate reasons that would justify limitations on live broadcasting.He did, however, prohibit visual broadcasts of the witness and the prohibition will remain in place until the case is finalised.In times of uncertainty you need journalism you can trust.
