Now, after suing for unfair constructive dismissal, an employment judge has upheld the surgeon's claims and said Mr Mamode was restricted from practice without 'adequate explanation' and for 'longer than necessary'. This led to a review of their transplant service and resulted in the immediate termination of Mr Mamode's contract - which was on an honorary basis - with the hospital as they found 'matters of concern' relating to his conduct. Employment Judge Liam Murdin said: 'He was also informed that he should step down from his role as Clinical Lead with immediate effect, and for the foreseeable future pending the outcome of the investigation.
While the surgeon was willing to accept the written warning again, he lodged an appeal on the 'open-ended nature' of the exclusions from the ECH. EJ Murdin said: ' alleges that his depression arose as a result of over 18 months of investigations, and unwarranted exclusion from his paediatric practice.'
