A top lawyer claimed it was a breach of his human rights to be disciplined over texts claiming he would have sex with the head of a rape charity “just to have something over her”

Acting for the whistleblower, Simon Di Rolla KC said the woman maintained the pair were first in contact after she first sought McConnachie’s professional advice. She said she believed he “used his professional position to gain her trust”. And he said all the messages were sent in the context of a “personal relationship of some intense intimacy” and therefore were private. But Mr Di Rolla said at the time the WhatsApp messages were sent, he had not met the woman.
He was not sanctioned for the comments about Ms Brindley as they were considered merely a “hypothetical” desire. He was found guilty of unsatisfactory misconduct over his claims about the KC as this was deemed disloyalty to another advocate.
