SCA finds SSA made 'material misstatements' in bid to block release of report on US and ANC
The Supreme Court of Appeal unanimously overturned a ruling – first obtained in secret proceedings by the State Security Agency – which barred Independent Newspapers from publishing the details of its"secret" report on alleged US perceptions of the ANC.
Writing on behalf of a unanimous full bench of the SCA, Judge Tati Makgoka found that the SSA"did not observe the duty of utmost good faith" when it applied for an urgent ex parte order that interdicted Independent and journalist Thabo Makwakwa from publishing any details of the report in December 2021.South Africans need to be in the know if we want to create a prosperous future.
