Most charges that are diverted happen after a charge is laid and Crown prosecutors make those arrangements. However, the law allows police to refer people to a diversion program in lieu of being charged, and potentially access the supports they need. She said police had one unsuccessful diversion this year, but there are not a lot of unsuccessful diversions. She investigates all failed diversions.
Police made 16 pre-charge diversion referrals out of the 23 made to the Crown in 2022 as of the report’s creation, but for the other eligible minor charges.
