The appeal court decision means a new hearing of the application to remove Don Windels from his roles at the Lighthouse yxe
MNP outlined a variety of issues in reports filed in October 2021, including loans made by the charity to Windels and another board member. In one case, the Lighthouse was found to have loaned Windels $60,000 to help him purchase a home for his daughter on Walmer Road, referred to in court documents as “the Walmer house.”
While the MNP reports pointed to “troubling” behaviour that may have warranted court-imposed remedies under the Non-profit Corporations Act, Justice David Gerecke failed to uphold Windels’ right to fair proceedings by denying him the opportunity to cross-examine MNP’s inspector, Barrington-Foote wrote.
Barrington-Foote also found Gerecke compromised the fairness of the proceedings by not granting Windels a requested adjournment.Article content Barrington-Foote also found Gerecke erred when he ruled that the application wasn’t barred by the Limitations Act, which sets time limits on when civil proceedings can be initiated, and in his characterization of the loan from the Lighthouse to Windels for the Walmer house.
