City officials shut down the only In-N-Out Burger restaurant in San Francisco because employees weren't obeying a city ordinance to verify indoor diners’ vaccination status, SFGate reported.

Oct. 21, 2021 -- An In-N-Out Burger executive has criticized the City of San Francisco after one of its restaurants was temporarily shut down Oct. 14 because employees didn’t obey a city ordinance to verify indoor diners’ vaccination status,A city Department of Health spokesperson said the restaurant on Fisherman’s Wharf had been warned “multiple times about the proof of vaccination requirement,” SFGate said.

The restaurant soon reopened for takeout service and outdoor dining but without indoor dining, SFGate said. In-N-Out's Chief Legal and Business Officer Arnie Wensinger issued a statement saying the city’s rule was"unreasonable, invasive, and unsafe to force our restaurant Associates to segregate Customers into those who may be served and those who may not, whether based on the documentation they carry, or any other reason."

“We refuse to become the vaccination police for any government,” Wensinger said."We fiercely disagree with any government dictate that forces a private company to discriminate against customers who choose to patronize their business. This is clear governmental overreach and is intrusive, improper, and offensive.”

In August, San Francisco became one of the first big cities in the United States to require proof of vaccination for restaurants with indoor dining, bars, clubs, and gyms with its“Many San Francisco businesses are already leading the way by requiring proof of vaccination for their customers because they care about the health of their employees, their customers, and this City,”said. “This order builds on their leadership and will help us weather the challenges ahead and keep our businesses open.
