Saanich threatens to clean up Old West Saanich Road property at owner's expense

The District of Saanich is threatening to bill the owner of a property on Old West Saanich Road for a clean-up after it says the owner repeatedly ignored fines and notices to properly store material on the lot.

Pictures taken by Saanich staff show a mountain of items around the property, including recyclable material, appliances, furniture, household fixtures, wood, metal, plastic, derelict boats, vehicle parts and a number of vehicles. Saanich council approved a staff recommendation Monday night to declare 5360 Old West Saanich Rd. a nuisance to ensure unsightly materials are removed from the property or properly stored.Saanich would pay for the costs of cleanup, but the bill would be added to the property’s taxes if not paid by Dec. 31.“It has become clear that the property owners are not going to comply with the provisions of district bylaws despite warnings and fines being issued,” a staff report noted.

The property, owned by John Phelps and occupied by his brother Dean Phelps, is violating bylaws including the Unsightly Premises Bylaw and Garbage Collection and Disposal Bylaw, according to Saanich staff.Last spring, they responded to complaints there were a number of unlicensed vehicles on the property and there was concern about debris and items close to O’Donnel Creek, one of the largest tributaries to Elk and Beaver Lake.

A series of inspections of the property between Aug. 24 last year and Feb. 17 this year confirmed the property remains unsightly and the lot continues to violate bylaws due to the significant accumulation of filth and discarded materials, the report said.>>> To comment on this article, write a letter to the editor: [email protected]
