The SCA has slammed the Judicial Service Commission, then led by Chief Justice Mogoeng Mogoeng, for finding dishonest drunk driver Judge Nkola Motata should not face impeachment – because he was drunk when he made racist and sexist comments.
In a scathing majority ruling, SCA Judge Nathan Ponnan found that the now retired judge’s conduct, during and after his drunken 2007 crash, had been “egregious”.
