The RCMP will only meet with privacy commissioner Philippe Dufresne at the end of August, meaning he did not have all the answers when he testified Monday before a Commons committee on use of spyware by the force.

Privacy commissioner Philippe Dufresne waits to appear before the Standing Committee on Access to Information, Privacy and Ethics on Aug. 8, 2022, in Ottawa. The Royal Canadian Mounted Police is not required to consult Canada’s privacy commissioner when it uses spyware technology to intercept emails and text messages “covertly and remotely.”
Philippe Dufresne, Canada’s newly named privacy commissioner, made this revelation at the start of parliamentary committee hearings looking into the RCMP’s use of device investigation tools, which first came to light in media reports. Dufresne said that while the RCMP says it prepared a privacy impact assessment on the use of such spyware in 2021, the PIA has not been transmitted to the commissioner, and the RCMP has not consulted with his office on its use of surveillance technology.
