A lack of U.S. ratification of the UNCLOS has provided China power in setting international policy and creates a legitimacy crisis for U.S. claims.

FAIRBANKS, Alaska - Amidst efforts to solidify claims in the Arctic, negotiations are a major part of the process. But the United States has not ratified a U.N. treaty that is impacting negotiations in the Arctic and elsewhere.

Congressional interest in ratification has increased, however, according to Sen. Murkowski much of the growing support is coming as a reaction to China’s increased interest in the Arctic and establishes dominance in disputed territory. “It’s something that congress needs to move on,” said Murkowski speaking to urgent developments.

While the United States doesn’t have say in UNCLOS developments for the moment, negotiations between the U.S. and other countries can happen separately. This is how the U.S. has already worked out borders with some countries in the Arctic as they each works to solidify the boundaries of their extended continental shelf.
