'Neither man backed down ... Neither man attempted to de-escalate the situation,' said judge who found accused not guilty
It was a dispute that started over pooch poop and ended up in a dogfight in a Sault Ste. Marie courtroom.
Nicholas Hurshman said he was walking his dogs near his Terry Fox Place residence - a street that has five apartment buildings on it.Hurshman testified that he waited for 30 seconds and didn't see anyone pick up the feces. The pair exchanged words, Maki ordered him to leave, and Hurshman told the court he responded by asking "what are you going to do tough guy?"
When Maki took the witness stand he told the judge that his pet was doing "his duty" about 8 a.m. when he spotted Hurshman crossing the street with two large dogs. During cross-examination, assistant Crown attorney Stuart Woods suggested that Hurshman didn't present a physical threat. A neighbour, who lived in another apartment building in the complex, was sitting in his kitchen looking out the window that morning.The accused approached Hurshman and started "pounding" him in the face, he said, and Hurshman let go of his dogs.
