Christiaan van Meyeren went to the appeal court after the Port Elizabeth high court ruled in 2018 that he was liable to pay Gerald Cloete damages for the injuries he suffered in the attack a year earlier.
“For nearly 200 years in SA, owners of animals have been held strictly liable for harm done by domesticated animals,” he said.
“People are entitled to walk our streets without having to fear being attacked by dogs and, where such attacks occur, they should in most circumstances be able to look to the owner of the dog for recompense.” The Port Elizabeth man who was horrifically mauled in a pitbull attack – in which he lost an arm – is suffering recurring nightmares that the dogs are still coming after him. Making a slow recovery but still in tremendous pain, Gerald Cloete, 40, miraculously survived the savage attack by three pitbulls in Rowallan Park on February 18.
