Except a former executive director, fired for cause, did indeed profit, illegally and immorally and enrichingly — far beyond the generous salary he received — breaking every covenant of his fiduciary position. Which means he was bound legally and ethically by a duty to preserve good faith and trust by putting the interests of others ahead of his own.
But Pennock, according to a recent court judgment, was living high off the hog and paying for it by ripping off his employer to the tune of more than $270,000. A 2020 audit found Pennock had filed numerous fraudulent expense claims, falsified invoices and created fake documents to portray the submissions as valid. He used his corporate credit card to charge personal travel, meals and entertainment expenses in the sum of $159,375.
“I find that Pennock’s conduct was high-handed, malicious and highly reprehensible, particularly given the clear evidence that he breached his fiduciary duty as set out in his contract of employment, he committed multiple acts of fraud and deception thereby depriving the plaintiff organization of a very substantial sum of money, which is funded by tax dollars collected by the government and as well through charitable donations.
On Oct. 19, 2021, Pennock was charged by Peel police with fraud over $5,000, breach of trust and six counts of uttering forged documents. The ruling say it’s unclear what has happened with those charges and the Star could find no record of them being addressed in the province’s court websites.
