Jeff doesn’t note that the OSC entered into a memorandum of understanding with the minister of finance in December 2019 in which the minister acknowledges that the OSC shall operate as an arm’s-length agency of the Government of Ontario, subject to an extensive accountability regime specified in the Securities Act and the MOU. The MOU specifies that the OSC’s regulatory and adjudicative decisions must be made and be seen by the public to be made in an independent and impartial manner.
It appears that the minister adhered to this agreement in considering the views of a majority of the then-incumbent commissioners who opposed the reappointment of Ms. Zordel as a part-time commissioner. While I enjoy Jeff’s felicity with phrases, in such circumstances his dismissal of the minister’s failure to consult on Ms. Zordel’s appointment as chair less then a year later as no more then a “tempest” that “easily fits within a standard-issue teapot” is naïve, if not disingenuous.
As a champion of accountability, Jeff should acknowledge that, irrespective of his views of Ms. Zordel’s suitability for the role of chair.Share this article in your social network
