JOHN'S, N.L. — A $12.5-million settlement that is “fair, reasonable and in the best interests” of those affected has been approved in the class-action lawsuit involving the abuse of youth at government-run facilities in the province in the 1970s and 1980s.

The province does not admit liability in the agreement, but says it recognizes that class members have disclosed accounts of serious harm. John Doe #10 alleged that two guards sexually assaulted him many times at the Whitbourne Training School in 1974. McGrath indicated in her decision that the province has paid the three amounts to class action counsel and the money is being held in trust.

Claims for settlement will be assigned a point value that determines the amount of money that will be paid. The maximum points that can be assigned to a claim is 100 points for a maximum value of $500,000.
