A sex worker in Nova Scotia is pursuing a claim for non-payment of services in small claims court, in a case she and her advocates hope will help shift the conversation about sex work in Canada.
In Canada, sex workers are allowed to sell their services, but the Protection of Communities and Exploited Persons Act, passed in 2014, criminalizes aspects of that work
While non-payment for services was something she'd experienced before, Brogan said she saw this incident as an opportunity to fight for sex work to be treated the same as other forms of employment."And so when something happened to myself, not being paid, I saw an opportunity to do something about it, to show other people that they can also they have rights as sex workers.
"Where it is in the sex worker's best interest to get paid for their work, it might be that we could argue that this kind of an illegal contract is still one that should be enforced, and that is what we will be arguing." "You have absolutely no idea who is walking through your door or whose door you're walking through, and chances are you won't find out unless something like this happens," Brogan said.
Emma Halpern, executive director of the Elizabeth Fry Society of Mainland Nova Scotia, said it's important for Canadians to recognize the difference. "I've heard many stories of women who are trying to make a safe, affordable living through sex work, and have found it very difficult for many of the reasons that Brogan has raised. I think there's still a long way to go from the perspective of our government in terms of making sex work a safe place for women."launched a constitutional challenge of the current legislation.
