The sentencing hearing of Robert Charles Rogers, a Yarmouth man convicted of second-degree murder in the September 2020 killing of Colton Cook, has been adjourned to March 16 to give the defence more time to prepare.

Rogers will automatically receive a life sentence on the conviction of second-degree murder. What needs to be decided, however, is how much time has to pass until he will be eligible to seek parole consideration. The minimum wait time is 10 years. The maximum wait time is 25 years. Two other people charged in connection with this crime are also awaiting sentencing after entering guilty pleas.
This isn’t the first conviction of extreme violence that Rogers has received. His criminal record also includes an October 2011 conviction of attempted murder. The victim was Rogers’ father, who he stabbed in the throat while he was asleep. Rogers’ sentencing in that case did not occur for over two years. Although convicted in October 2011, he was not sentenced until January 2014. The numerous and ongoing adjournments in his sentencing came about because Rogers was not represented by a lawyer. He had fired his lawyer after the jury found him guilty of attempted murder and he repeatedly told the court he had not been able to secure a new lawyer. The first year alone after his conviction saw a half dozen sentencing date adjournments.
