Non-payment of child maintenance is a criminal offence.
Legal Analyst Mpumelelo Zikalala says the Memorandum of Understanding signed by the Justice and Constitutional Development Minister, Thembi Simelane with the Consumer Profile Bureau and Social Justice Foundation, will make it easier to track child maintenance defaulters.
The MOU will allow for the personal details of child maintenance defaulters to be given to Credit Bureaus and credit providers so that it is difficult for maintenance defaulters to obtain credit. Non-payment of child maintenance is a criminal offence and carries imprisonment terms not exceeding one year.
Zikalala says creditors will use the maintenance defaulting data as part of their affordability analyses. “If you are failing to pay your maintenance order, how is it that you are going to pay for that new car, for that new house or even that new debt that you are applying for. It’s one of the ways they will be forced to say, start with family matters first. Start with paying your maintenance orders before you seek new loans or new credit that you might be able to find.
