Modiadie v SABC: Sexual harassment case heads to high court
The SABC is defending a R3.5 million claim brought by former Metro FM presenter Pearl Modiadie to the Johannesburg High Court, following sexual harassment allegations levelled against her former boss, Anthony Soglo.
City Press previously reported that Modiadie filed a claim seeking to hold the SABC vicariously liable for the incident by accusing the public broadcaster of failing to implement its sexual harassment policy framework when the matter was internally reported. “The plaintiff is in the wrong forum as the complaint should have been referred to the CCMA following an unsuccessful internal grievance procedure. In the circumstance, the plaintiff’s claim, as against the first defendant, stands to be dismissed with costs,” reads part of the papers.
The broadcaster further argued that the grievances, based on the sexual harassment policy framework, did not empower her to bring a claim for damages.
