Mark Bagguley was in control of the drone last July, which flew dangerously close to the wing of a Hawker Hurricane. The plane was flying from RAF Coningsby in Lincolnshire to Blackpool and flew as low as 365ft.

He then looked through his images, hoping to edit the bird out, before realising what it was and reported it to the Civil Aviation Authority. Prosecutor Annabel Lenton told Derby Crown Court she believed the case to be the first of its kind in the UK. She said the carnival was watched by between 15,000 and 20,000 people, but Bagguley who had no previous convictions, did hold a licence and insurance.

PC Matthew Moore, a flight safety officer with the force, was asked by the judge to answer any questions in court about drone legislation. He said that drones are only allowed up to 400ft from the nearest point to the ground without special permission. However, he claims that "internet issues" meant he could not check the times of the restriction. Therefore, he decided to fly the drone anyway, believing there was 45 minutes before the restrictions came into force.

In a letter read out in a previous hearing, Bagguley apologised for his "reckless actions." He said: “I wish to state my gratitude and relief that there was no contact with the Hurricane.
