A judge ruled that part of her case should be struck out including claims that the publisher had behaved 'dishonestly'
- requested that parts of Meghan's claim be dismissed. Judge Mr Justice Warby struck out allegations that the publisher acted 'dishonestly' by leaving out certain parts of the letter, as well as claims that the publisher deliberately 'stirred up' issues between Meghan and her father. He also dismissed the accusation that the newspaper had an 'agenda' of publishing intrusive or offensive stories about her.
Justice Warby said that the struck out claims don't go to the 'heart of the case, which at its core concerns the publication of five articles disclosing the words of, and information drawn from, the letter written by the claimant to her father in August 2018'. He said that those particular claims were 'irrelevant' to her claim for misuse of private information, copyright infringement and breach of the Data Protection Act.
However, the Duchess' legal representatives have since issued a statement saying that they will continue to proceed with the case and that the ruling didn't change its 'core elements'. 'The duchess’s rights were violated; the legal boundaries around privacy were crossed,' added the spokesperson for Schillings.
'As part of this process, the extremes to which the Mail on Sunday used distortive, manipulative, and dishonest tactics to target the Duchess of Sussex have been put on full display.'
