Calgary motorist Brice William Coates was handed the maximum punishment Thursday for making an unsafe left turn that resulted in a fatal collision with a speeding cyclist yyc
But provincial court Judge Judith Shrier stressed to those in court mourning the loss of Cory Meza that the $2,300 fine and surcharge and three-month driving suspension handed to Coates wasn’t meant to lessen their loss.
The widow, who was 29 at the time of her husband’s death, said Meza was so much more than the cyclist he was referred to as throughout much of the trial.Article content Shrier agreed with Crown prosecutor Renato Di Lorenzo that the maximum punishment under the provincial legislation was warranted in light of the fact Coates did not have a clean driver’s abstract as well as the tragic consequences of his actions.Defence counsel Stephen Bitzer had argued for a fine of $1,000 and a seven-day driving suspension, indicating that although the result of his client’s conduct was as severe as could be, his driving pattern wasn’t egregious.
Shrier found that under the act, once the Crown has established an unsafe left turn was made, the onus is on the defence to show it was unavoidable.
